New Swimming Pool Compliance Certificate

If you intend to buy, sell or lease a property with swimming pool after 29 April 2016, there are some new rules to be aware of.

  1. Sellers or landlord will require a valid swimming pool compliance certificate (valid for three years) or occupation certificate (with a registration certificate);
  2. For sellers, if the certificates in 1 cannot be obtained, they will be able to shift the responsibility to the purchaser by issuing a certificate of non-compliance (valid for one year) with their Contract for the Sale of Land;
  3. The purchasers then need to rectify the non-compliance issues within 30 days; and
  4. Strata plan or off the plan properties will be required to meet the above requirements. In other words, the new rules are mainly targeting the houses with swimming pools attached.

The Vendor who intends to sell the property with a non-complying swimming pool in one year is suggested to apply for a non-complying certificate.
